Följer väststaterna folkrätten när de bombar i Libyen?

Redan på den andra dagen av väststaternas aktion mot Khadaffistyrkorna har det kommit in omfattande protester (se al-Jazeeras Libyen-blog).
Amr Moussa, Arabförbundets generalsekreterare säger:
What is happening in Libya differs from the aim of imposing a no-fly zone, and what we want is the protection of civilians and not the bombardment of more civilians.
En rysk diplomat säger:
We believe a mandate given by the UN Security Council resolution-- a controversial move in itself - should not be used to achieve goals outside its provisions, which only see measures necessary to protect the civilian population.
Det är för tidigt att säga något bestämt om vad bombningarna haft för effekt, t ex om det finns civila offer (även om den libyska regeringen påstår det). I sak har den ryske diplomaten rätt (se min förra blogg) medan Moussa kanske glömt att det i resolutionen finns två OLIKA mål, nämligen att införa en flygförbudszon OCH att skydda civila. För att uppnå dessa mål kan en del civila offer accepteras av folkrätten om den militära effekten motiverar det. Detta är förstås paradoxalt, eftersom den (yttersta) militära effekt som ska nås är just att skydda civila. Livet är dock fullt av paradoxer, en del av dem tragiska.
Att avsätta Khadaffi är i sig inget legalt mål enligt FN-resolutionen, även om man förstås kan säga att det kanske vore nödvändigt för att skydda civila. Om det nu skulle uppstå ett dödläge genom att Khadaffis framryckning hindras måste det till en politisk process, kanske med hjälp av FN-medling. Bäst vore förstås om Khadaffi kunde lämna scenen, men det kommer knappast att ske frivilligt. Vad som än händer måste den interna utvecklingen drivas av libyska krafter.

On 25 April 2008, the Security Council adopted Resolution 1810 (2008), which extended the mandate of the 1540 Committee for a period of three years, with the continued assistance of experts, until 25 April 2011. Reaffirming the objectives of Resolution 1540 (2004) and Resolution 1673 (2006), the Security Council urged the 1540 Committee to continue strengthening its role in facilitating technical assistance, including by engaging actively in matching offers and requests for assistance, therefore confirming its clearinghouse function. Through Resolution 1810 (2008), the Security Council also requested the 1540 Committee to consider a comprehensive review of the status of implementation of Resolution 1540 (2004). The 1540 Committee decided to hold an open meeting with broad participation which will form part of this comprehensive review. The open meeting took place at UN headquarters from 30 September to 2 October 2009.

The 1540 Committee released its first report to the United Nations Security Council on implementation of the Resolution in April 2006. The second one was presented in July 2008. A third report is expected by 24 April 2011, as requested in Resolution 1810 (2008).
